1. Provider and scope

These Terms and Conditions apply to the use of GS4u and orders for paid services.
2. Use and user accounts
The website is intended for people aged 16 and over. Paid services may only be ordered by adults. Anyone acting on behalf of a business or another person must be authorised to do so. Customers whose registered office or residence is in Russia receive paid services only as natural persons for private use.
Certain features require a user account. Premium Points can also be ordered without an account. Login credentials must be protected against unauthorised use. Please notify us without undue delay if you notice signs of unauthorised access.
You must not use the website to publish unlawful content, infringe third-party rights or misuse the service's features. In particular, unauthorised access, unauthorised manipulation of ratings or rankings, and deliberate disruption of the service are prohibited.
3. GS4u services
GS4u provides information about game servers, monitors their status and offers features to improve their visibility on GS4u. GS4u does not operate the listed game servers.
The nature and scope of a paid service are determined by the service description in effect when the order is placed and the service selected.
Premium Points count towards the selected server’s position under the ranking method described on GS4u. Any predicted position shown is an estimate based on current data. A fixed position over time or a particular number of new players is not guaranteed.
PLUS status includes the additional monitoring features and benefits listed in its service description.
The paid version of the GS4u app for VK communities includes the app and widget features listed in its service description for the selected community.
4. Orders and formation of the contract
By placing an order expressly identified as requiring payment, you make a binding offer to enter into a contract. GS4u automatically accepts this offer after successful payment. The service starts at the time shown during the order process.
5. Prices and payment
The price payable is the total shown before you place your order.
GS4u uses the small-business VAT scheme under section 19 of the German VAT Act (UStG). All taxes and other mandatory charges applicable to an order are included in the displayed total price.
Available payment methods are shown during checkout. Payment is processed by the selected payment service provider.
6. Duration and repeat orders
Premium Points are valid for 30 days from activation. A further order does not extend the validity of previously purchased Premium Points. Once their respective validity period ends, those points no longer count towards preferential placement.
PLUS status is valid for one year from activation. If PLUS is already active, an extension can be purchased during the last 90 days of its current validity period and adds one year to that period.
The paid version of the app for VK communities runs for the term chosen when ordering. If a trial or paid term is already running for the community, the new term starts when it ends.
Each order requires a single payment. There is no automatic paid renewal or subsequent automatic charge. The service ends when the paid period expires, without the need to terminate the contract. The right to terminate for good cause remains unaffected.
7. Non-use, removal of a server and refunds
No voluntary refund is provided for non-use of a service that has been properly made available. Statutory rights to refunds and early termination remain unaffected.
The service is tied to the server or community selected at purchase. A transfer requires GS4u’s approval in each case and is carried out manually. GS4u is not obliged to approve a transfer.
If the server is removed from monitoring, the features linked to its listing are no longer available. Refunds are governed by law, taking the reason for removal into account.
8. Withdrawal
Consumers have a statutory right to withdraw from the contract, generally within 14 days. The separate withdrawal instructions explain the time limit and how to withdraw. They also include the model withdrawal form.
If the consumer withdraws, payment for the part of the service provided up to notification of withdrawal is due where the statutory conditions are met and to the extent provided by law. The remaining refundable amount is returned to the customer.
9. Prohibited content and restrictions on use
In cases of unlawful content, infringement of third-party rights or a significant breach of these Terms and Conditions, GS4u may remove the affected content or restrict access to the extent necessary and proportionate. Where required by law, GS4u issues a warning or sets a deadline to remedy the breach before terminating the contract.

10. Defects and liability
Statutory rights apply to defects in the service.
GS4u’s liability is unlimited in cases of intent or gross negligence and for death, personal injury or harm to health caused intentionally or negligently.
In all other cases of ordinary negligence, GS4u is liable only for a breach of essential contractual obligations and only for loss that was foreseeable when the contract was concluded and is typical of this type of contract. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible and on whose fulfilment the customer may ordinarily rely.
These limitations do not apply to fraudulent concealment of a defect, claims under guarantees given by GS4u, or liability that cannot be limited by law. Where GS4u’s liability is excluded or limited, the same applies to the personal liability of its legal representatives and persons engaged to perform its contractual obligations.
11. Changes to existing contracts
The version of these Terms and Conditions agreed upon when the contract was concluded applies to that contract.
